Chapter 8.09 - Single-Use Foodware Accessories and Standard Condiments

1. California law AB 1276 requires all retail food facilities and food delivery platforms to provide single-use foodware accessories and condiments upon request only. Law states:
   1. Single-use foodware items cannot be bundled together. 
   2. Single-use foodware accessories and condiments can only be provided upon request, except at drive-throughs and airports, where staff can ask if a customer wants single-use foodware accessories.
   3. Food facilities using third-party delivery platforms can only provide single-use items and condiments that have been requested by a customer during the online ordering process.
   4. Foodware items covered by the law include single-use utensils, straws, chopsticks, stirrers, and condiment cups and packets.
   5. Facilities found in violation of the law may be fined.
2. How this might affect restaurants:
   1. Inform staff that items must be requested, not provided by default.
   2. Post signage to let consumers know they can ask for what they need.
   3. Eliminate bundled single-use items.
   4. Self-serve stations are allowed as long as items are not bundled or wrapped. Consider providing bulk dispensers for condiments.
   5. Update online ordering menus to allow consumers to request each available accessory or condiment.

Chapter 8.04.210 - Clearing of Waste Matter, Debris, and Vehicles from Private Property

1. City may require restaurants or businesses to install a locking mechanism on trash, recycling, and/or organics bin(s) if deemed necessary due to container not being properly maintained of trash/debris or if other environmental issues are prevalent
2. How this might affect restaurants/businesses:
   1. Cost of locking mechanism will be at businesses' expense as a one-time installation fee from garbage company 
   2. Train employees on keeping bin locked if not actively in use 

• Adding the definition of "property owner" to include HOAs
• Clarifying list of allowable exceptions to illegal discharge to include all those listed by the Clean Water Act
• A list of construction site best management practices (BMPs)
